These Terms and Conditions (the “Terms”) govern your access to and use of the website operated by Common Core Marketing (“Common Core Marketing,” “we,” “us,” or “our”), including any content, features, functionality, and services offered through our website at commoncoremarketing.com (the “Site”).

By accessing or using the Site, you agree to be bound by these Terms and our Privacy Policy (which is incorporated by reference). If you do not agree, do not use the Site.

Changes to These Terms

We may update these Terms from time to time. The “Effective Date” at the top shows when these Terms were last updated. Changes are effective when posted on the Site. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

Who We Are and What the Site Is For

Common Core Marketing provides marketing-related information and may offer marketing services (the “Services”). The Site may include informational content (blog posts, guides, case studies), contact forms, scheduling tools, and related resources.

No professional advice. Content on the Site is provided for general informational purposes only and is not legal, accounting, or financial advice. Marketing results depend on many factors and are not guaranteed.

No client relationship created. Using the Site or contacting us through the Site does not, by itself, create a client relationship. Any services we provide will be governed by a separate written agreement (such as a proposal, statement of work, or master services agreement), and those terms will control in the event of a conflict with these Terms.

Eligibility

You must be able to form a legally binding contract to use the Site. By using the Site, you represent that you are at least 18 years old (or the age of majority where you live) and have the legal capacity to agree to these Terms.

The Site and its content, including text, graphics, logos, designs, compilations, and software, are owned by or licensed to Common Core Marketing and are protected by intellectual property laws.

Trademarks. “Common Core Marketing” and our logos are our trademarks. You may not use our trademarks without our prior written permission.

Your Submissions

If you submit information through the Site (e.g., contact forms, scheduling requests, emails, chats, or other communications), you agree that:

  • The information you provide is accurate to the best of your knowledge
  • You will not submit content that is unlawful, defamatory, infringing, or otherwise harmful
  • You will not submit confidential or sensitive information you do not wish to share through the Site (for example, passwords, financial account numbers, or highly sensitive business secrets)

Feedback. If you voluntarily provide suggestions or feedback about the Site or our Services, you agree we may use that feedback without compensation or restriction.

The Site may contain links to third-party websites, tools, or services (for example, scheduling tools, embedded video platforms, or social media). We do not control and are not responsible for third-party content, policies, or practices. Your use of third-party services is at your own risk and subject to their terms and policies.

Communications, Email, Calls, and Text Messages

Electronic Communications

By using the Site or contacting us, you consent to receive communications from us electronically, such as by email or through the Site. You agree that electronic communications satisfy any legal requirement that such communications be in writing.

Telephone Calls and SMS/Text Messaging Terms

If you provide your phone number to us, you agree that we may contact you at that number by phone call and/or SMS text message as described below, consistent with our Privacy Policy and your preferences.

Program purpose. Calls/texts may include service-related messages (e.g., scheduling, onboarding, project updates, support) and, where permitted, marketing communications about our Services.

Consent; not required for purchase. Where required by law, we will request your consent before sending marketing texts/calls. Your consent is not a condition of purchase.

Autodialing/prerecorded messages. We may use automated technology and/or prerecorded messages where permitted by law and consistent with your consent.

Message frequency. Message frequency varies.

Message and data rates may apply. You are responsible for any message/data charges from your mobile carrier.

Opt out. You can opt out of text messages at any time by replying STOP. After opting out, you may receive one final confirmation message.

Help. Reply HELP for help, or contact us using the information in the “Contact Us” section below.

Carrier/phone responsibility. You represent that you are the account holder or have authorization to use the phone number you provide. If your number changes, you agree to notify us or opt out and re-enroll with your new number.

No emergency services. Text messages are not monitored 24/7 and are not a method for emergency communications. If you have an emergency, call 911 (or your local emergency number).

Service provider role. Mobile carriers are not liable for delayed or undelivered messages.

Disclaimers

No Guarantees

Marketing outcomes are inherently variable. We do not guarantee specific results (including leads, conversions, rankings, revenue, or ROI) unless expressly stated in a separate written agreement signed by both parties.

Site Provided “As Is”

The Site and its content are provided on an “AS IS” and “AS AVAILABLE” basis. To the fullest extent permitted by law, we disclaim all warranties of any kind, express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that the Site will be uninterrupted, secure, error-free, or free of viruses or other harmful components.

Limitation of Liability

To the fullest extent permitted by law, Common Core Marketing and its owners, employees, contractors, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages (including lost profits, lost revenue, lost data, or business interruption) arising out of or related to your use of (or inability to use) the Site.

To the fullest extent permitted by law, our total liability for any claim arising out of or related to the Site will not exceed $100 or the amount you paid to us (if any) for access to the Site in the 12 months prior to the event giving rise to the claim, whichever is greater.

Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.

Indemnification

You agree to defend, indemnify, and hold harmless Common Core Marketing and its owners, employees, contractors, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or related to:

  • Your use of the Site
  • Your violation of these Terms
  • Your violation of any law or regulation
  • Your submission of content or information that infringes or violates the rights of another party

Termination

We may suspend or terminate your access to the Site at any time, with or without notice, if we believe you have violated these Terms or if we discontinue the Site.

Sections that by their nature should survive termination will survive (including Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Governing Law).

Governing Law and Venue

These Terms are governed by the laws of the State of Wisconsin, without regard to conflict of laws principles.

Any dispute arising out of or related to these Terms or the Site will be brought exclusively in the state or federal courts located in Wisconsin, and you consent to personal jurisdiction in those courts.

Copyright Complaints

If you believe content on the Site infringes your copyright, you may contact us with the following information:

  • Identification of the copyrighted work you claim has been infringed
  • Identification of the material you claim is infringing and where it appears on the Site
  • Your contact information (name, address, phone number, email)
  • A statement that you have a good faith belief the disputed use is not authorized
  • A statement, under penalty of perjury, that your notice is accurate and that you are the copyright owner or authorized to act for the owner
  • Your physical or electronic signature

Miscellaneous

Severability. If any provision of these Terms is found unlawful or unenforceable, the remaining provisions will remain in effect.

No waiver. Failure to enforce any provision of these Terms is not a waiver of our right to do so later.

Entire agreement. These Terms and the Privacy Policy constitute the entire agreement between you and Common Core Marketing regarding the Site and supersede any prior agreements or understandings relating to the Site.

Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms as part of a merger, acquisition, or sale of assets.
